Terms & Conditions
Welcome. This is the
Member Agreement, a contract between NewLawyer and you. As a business entity
under the name NewLawyer, will hereinafter be cited as "NewLawyer."
Once your Members Sign-up Form is accepted by NewLawyer, you will be a
"Member" with access to the Legal experts Services and the Site in
accordance to the terms and conditions and policies below. For convenience, the
NewLawyer website, Mail, phone services and any material from NewLawyer will be
cited as the "Site." Any entertainment services, information and
other services or products received from external Members (under Legal expert
capacity) or their Site listings will be cited as "Legal experts
Services." Those members, who sign the given Member Agreement and who
request or get similar from other Members shall be cited as
"Members." Those members who make listings or/and offer Legal experts
Services shall also cited as "Legal experts".
NewLawyers obligations and
liabilities are limited to the policies below, which permit NewLawyer to
revise, suspend or cease your entree and usage of the Legal experts Services
and the Site. Please read all the policies mentioned below or on the website
carefully. The given Member Agreement contains the documented rules and policies
and gives additional terms and conditions: Payment Policy, Legal experts
Policy, Privacy Policy, Feedback Policy, Age Verification Agreement and Photo
Policy. In the case of issues between the conditions in the linked policies and
the Member Agreement, the latter document's terms and conditions shall prevail.
IT IS UNDERSTOOD THAT BY
ACCESSING THE REGISTRATION PAGE, BY USING THE LEGAL EXPERT SERVICES AND THE
SITE, YOU ARE CONSENTING TO ADHERE TO THE MEMBER AGREEMENT WHICH OBLIGATES YOU
IN THE SIMILAR MANNER AS A WRITTEN CONTRACT DOES. USAGE OF THE LEGAL EXPERTS
SERVICES AND THE SITE IS SUBJECT TO THE MEMBER AGREEMENTS TERMS THAT INCLUDE
THE DOCUMENTED TERMS INTEGRATED AT THE SITE. YOU MUST CONSENT TO ALL THE
POLICIES STIPULATED IN THIS CONTRACT WITHOUT REVISION FOR YOU TO GAIN ENTRY TO
THE WEBSITE AND THE LEGAL EXPERTS SERVICES. IF YOU DONT CONSENT TO THE TOTALITY
OF THIS MEMBER AGREEMENT, YOU ARE REFUSED ENTREE OR USAGE OF THE WEBSITE OR THE
LEGAL EXPERT SERVICES.
1. Limited Website and the
Legal experts Services Usage Eligibility.
The Website and the Legal
expert Services could be accessed and used only by persons at a minimum of
eighteen (18) years of age. Without this limitation, the Website and the Legal
expert Services are unable to suspend Members indefinitely or temporarily.
Usage of the Website or
Membership is not permitted if your location is situated in a country (a) where
laws prohibit usage or participation or (b) is banned from trading with the United Kingdom
or the United States
or its people.
2. Usage or provision of
Legal expert Services and Legal expert consultation are at your personal risk.
(a) The Legal expert
Services and any information exchanged between Members are not evaluated,
produced, provided or controlled by NewLawyer in any way. The services of
verification contained in Legal expert's listings are from third parties.
NewLawyer, neither supplies any content nor guarantees, verifies or represents
any Legal experts. NewLawyer also holds no editorial control over any content, sexually
offensive or otherwise. NewLawyer is also not liable for any non-compliance by
an Legal experts with the laws or regulations on listings content. NewLawyer
serves only as technology service allowing Members to correspond with one to
another. The Site is not purposed as a payment avenue for the exchange of goods
making NewLawyer not liable for any such transactions among Members. NewLawyer
judgment should be applied in accessing the Website and the Legal experts
Services and in giving out confidential data to other Members, although
NewLawyer recommends you against doing the latter. NewLawyer neither monitor
Members feedbacks nor police Members in any manner. In case you notice lawful
violations or fraudulent or violent actions among Members, NewLawyer advises
that you ask help directly from the police.
(b) Neither content
supplied by Members or Legal experts nor groups of Legal experts or Legal
experts have New Lawyers endorsement or guarantee. Member's telephone
conversations are not monitored by NewLawyer, in conformity with the Privacy
Policy. The company, however, reserves its right to review Mail or contact
Members without identity disclosure for the evaluation of compliance to the
policies stipulated in the Member Agreement and always to act as stated in the
given Privacy Policy. So, you are urged to understand and review the Privacy
Policy of this contract before agreeing to its conditions and terms, as you are
legally obligated to abide by them as a Member.
(c) In case of conflicts
with other Members as a result of using the Legal experts Services, you waive
all claims on NewLawyer and release them from all types of liabilities. A
resident of California
waives his rights as given in the California Civil Code §1542. Residents
corresponding to other nations and states waive all their rights under
statutes, analogous laws or regulations.
3. Modifications of the
Member Agreement or suspension or termination of your site Usage could be done,
without prior notice.
(a) The company reserves
its sole discretionary right to revise or cease the website or to alter the
conditions and terms of website usage, without notice. The applicability of the
modifications will commence after be thirty days after initial posting on the
website. Revisions to the given Payment Policy will be effective after the
fourteen (14) day notice provided by NewLawyer to Legal experts through email.
You could opt to end your Website and the Legal experts Services usage should
you find any revision unacceptable. If you continue to use NewLawyers services
following a revision posting, it is already understood that you agree to adhere
to the new policies.
(b) Without prior notice,
your membership or Site access may be suspended or terminated by NewLawyer at
any time. Furthermore, NewLawyer, without notice, may notify the authorities
and/or your bank or take any action they deem appropriate, (i) if you are
suspected of non-compliance to the provisions stipulated in your contract (ii)
if the billing information you provided could not be authenticated by
NewLawyer, and/or (iii) if your actions are suspected to be illegal and could
cause liabilities. In turn, you also hold rights to end your membership with
NewLawyer. However, your payment obligations to NewLawyer will not be affected
by any termination, suspension or cancellation done.
4. The Site is a location
for Member listings.
The company serves only as
a communications interface facilitator among Members. You are accountable for
all essential equipment needed for the Website and the Legal experts Services
access and usage and for all tax reports and payments related to NewLawyers
fees.
5. You alone are liable
for all Website and the Legal experts Services usage and for the payment of all
purchased Legal experts Services under your personal password and Member
information.
(a) The Legal experts
Services rates are stipulated under the relevant Legal experts listing. By
"transaction" we mean any recorded or live call or any Mail
correspondence from an Legal experts, who charges fees for responses by email
("Paid Mail") done through the Site utilizing your password and
Member account data. You hereby give NewLawyer full authority on any fee
collection done through deducting from your Member account at the end of each
transaction. Recorded and live calls are charged according to the per minute
listed rates and call duration calculations or to NewLawyers periodic offers of
a priced package of bulk time. Bulk calls have expiry dates and refunds are not
given if you are unable to use up all your call time by the date of expiration.
As the recipient of a Pad Mail, you are immediately charged upon acceptance.
You give NewLawyer authority to make necessary verifications on your Member
account or/and listing information validity.
(b) You consent to preserve
your Member account information and passwords confidentiality and to look over
all actions that happen under them.
(c) You consent that
NewLawyer has no liability for any incurred loss caused by an unauthorized
person's usage of your Member password or account. You consent that your
provided information may be utilized by NewLawyer as stipulated in the given
Privacy Policy.
(d) Based on the company's
sole discretionary powers in determining the Member account's usage and
factors, they may ask for your credit, identity or/and background information
verification for your continued Site usage. In such cases, you consent to
giving NewLawyer the added information requested and to get a customer credit
report from customer credit reporting companies and to confirm the
identification.
6. You consent compliance
with the following on the Website or the Legal experts Services access or
usage:
(a) You (being an Legal
experts giving Legal experts Services) will be held accountable for content
provisions and listings content made under the Member account.
(b) You (being a Member
getting Legal experts Services) cannot store or record any Legal experts
Services gotten through the website. In the same way, you (being an Legal
experts giving Legal experts Services) shall not also do the same with any
calls made with Members. Despite this, Legal experts may offer a pre-recorded
voice Legal experts Service (or a "Recorded Listing", as identified
on the Sites Help page) to Members with conformity to the Legal experts Rules Policy.
(c) The Site is not to be
used for any acts that are unlawful or adverse to this contract and with
NewLawyers policies. Your full cooperation with NewLawyers investigation of any
alleged unlawful activity should include giving authorized representatives
entree to any part of the Member account.
(d) You shall neither ask
nor give advice, orally or written, pertaining to securities value or to the
feasibility of securities investment, purchase or sale.
(e) You shall perform all
charged communications with Members solely through the website and shall not
use external payment services.
(f) The Site should not be
utilized as a means to harass other Members or as an interference to the Sites
utilization or enjoyment by another.
(g) Don't attempt to
access the Sites computer systems, networks or Members account information
without authority.
(h) Don't attempt to get
any data or materials pertaining to the website through ways that are not
offered intentionally through it.
(i) Don't copy any Site
portion without an expressed written authorization from NewLawyer.
(j) Continue providing
NewLawyer with accurate payment registration data that is current. Update
personal contact data given to NewLawyer promptly, as necessary. Don't
impersonate, use fake identities or utilize a name you're not sanctioned to
use.
(k) Don't use the website
for Member solicitation, for product or service promotion not under the data
services stated under the Member listing, for provision of any services or
products pertaining to lottery number data success claims or for making
marketing proposals.
(l) Transmission of
'spam', 'chain letters' or "junk mail or unasked notice board postings or
emails mass distribution or transmission of requests for contractors, employees
or consultants or for other website participation is not allowed. For further
stipulations, view our Anti-Spam Policy.
(m) The Site is not to be
used for give-away, bonus item, prize, game of chance, contest or random
drawing promotions.
(n) Don't do anything that
may de-value the referral system of Members or the feedback system for Members
utilized to secure Member feedback. This includes imparting negative comments
for a Members failure to do something that is beyond the service scope
stipulated in his Member listing.
(o) Don't make offensive,
defamatory, obscene, hateful or tasteless content or Member names for listings.
(p ) Stand by all
applicable regulations and laws regulating your actions pertaining to the
website and (being an Legal experts giving Legal experts Services) be held
liable for following the particular requirements of relevant record keeping
laws, which include but are not limited to, the meeting of the requirements of
regulations such as 18 U.S.C. 2257 and others.
(q) Don't instruct or
encourage other individuals to conduct the foregoing or go against Member
Agreements terms and company policies.
7. Between the different
parties, the company shall hold all website ownership including any content
made or gotten from the website and all URLs.
You shall hereby give to
the company all rights, interests and titles in and to any ratings,
suggestions, materials or/and comments you submitted under the feedback system
for Members. You give the company the right to utilize or document your name
elsewhere and on the website for its promotion without your approval or
compensation.
8. As an Legal experts,
you are subject to and need to comply with NewLawyer's Payment Policy and Legal
experts Rules Policy.
NewLawyer's Payment Policy
and Legal experts Rules Policy are found on the Payment Policy pages and Legal
experts Rules Policy and are integrated into this contract by documentation.
9. Maintenance Fee for the
Account.
NewLawyer does not charge a maintenance fee for hosting a profile on the site.
10. Any Website and the Legal experts Services warranties or representations
are disclaimed by NewLawyer.
THE WEBSITE AND ANY LEGAL
EXPERTS SERVICES OR COMMODITIES ACQUIRED THROUGH THE WEBSITE ARE SUPPLIED
"AS IT IS", WITH NO KIND OF WARRANTY OF ANY SORT. THE COMPANY AND ITS
SUPPLIERS, EXPRESSLY DISCLAIM ALL WARRANTIES PERTAINING TO THE WEBSITE, THE
LEGAL EXPERTS SERVICES AND EVERY CORRESPONDENCE BETWEEN MEMBERS DONE THROUGH
THE WEBSITE. Furthermore, the company makes no guarantee that the Sites
operation will be fault free. Certain states don't permit warranty exclusions,
so the above-stated exclusions in some cases may not be applicable to you.
11. The company's
liability for your Website and Legal experts Services entree and usage is
limited. You alone are accountable for your Sites usage.
THE COMPANY OR ITS
SUPPLIERS ARE IN NO WAY ACCOUNTABLE FOR ANY DAMAGES RESULTING FROM OR
PERTAINING TO THE SITE AND LEGAL EXPERTS SERVICES USAGE, REGARDLESS OF THE
COMPANY BEING ADVISED OF THE POTENTIAL OF SUCH DAMAGES. WITHOUT CURBING THE
GENERALITY OF THE FOREGOING, THE COMPANY AND ITS SUPPLIERS AGGREGATE
ACCOUNTABILITY TO YOU, PERTAINING TO THIS AGREEMENT, SHALL NOT EXCEED (a)
NEWLAWYERS TOTAL FEE EARNINGS FROM YOU (FOLLOWING PAYMENTS TO OTHER THIRD
PARTIES AND LEGAL EXPERTSS) IN THE PAST 12 MONTHS (b) 100 DOLLARS (ONE
HUNDRED). The limitation or exclusion of damages is not permitted in some
states, so the stipulations above may not be applicable to you.
YOU CONSENT TO HOLD
NEWLAWYER AND EVERYONE UNDER THEM AS HARMLESS AND DEFEND THEM FROM ANY
ACCOUNTABILITY RESULTING FROM YOUR UTILIZATION OF THE WEBSITE OR FROM THE LEGAL
EXPERTS SERVICES PROVISION, INCLUDING ANY ACCOUNTABIILITY OR COSTS RESULTING
FROM ALL LOSSES, DAMAGES, SUITS, LITIGATION COSTS, JUDGMENTS, ATTORNEYS FEES
AND CLAIMS, OF ANY KIND. In each case, the company will give you formal written
notice pertaining to such action, claim or suit. NewLawyer has the right to
hold back payments to you to set off costs and accountabilities covered here.
12. The company bans the
illegitimate utilization of copyrighted trademarks and materials.
THE WEBSITE OR THE LEGAL
EXPERTS SERVICES SHALL NOT BE UTILIZED BY YOU FOR THE TRANSMISSION OR PROVISION
OF CONNECTIONS TO STORE MATERIALS THAT VIOLATES COPYRIGHTED TRADEMARKS, WORKS
OR INFRINGES OR ENCOURAGES THE VIOLATION OF ANY THIRD PARTYS RIGHTS ON
INTELLECTUAL PROPERTY.
NewLawyer has espoused and
set in place a policy, given below, that stipulates for the appropriate
cessation of Members that violate or suspected to violate copyright holders'
rights or of those who hold federally registered trademarks. This also applies
to those who hold unregistered trademarks in specific circumstances.
The company's Trademark
Related and Copyright Policy:
If you think that your
work has been plagiarized in a manner that violates your copyright, please
given the company's Copyright Agent stated below with the following data as
required under 17 U.S.C. § 512:
(a) An electronic or
physical signature of a certain person empowered to represent a the sole right
owner that has allegedly been violated;
(b) Verification of the
copyright work claimed as infringed, or a representative list of such works in
the Site, if multiple copyrighted works at a single online site are covered by
a single notification;
(c) Verification of the
material claimed to be infringed or the subject of infringement, that is for
removal or disabling of access and information enough to allow NewLawyer to
find the material;
(d) Fairly sufficient
information that allows NewLawyer to contact the complainant, including a name,
telephone number, address and an email address;
(e) A statement on the
complainants belief that utilization of the content in the manner that is
subject to the complaint is not approved by the copyright owner, law or agent;
and
(f) Statement that
notifications information is accurate and that the complainant is empowered to
represent the owner of the exclusive right allegedly infringed.
On receipt of such notice
as depicted above, the company will employ the deemed appropriate action, at
its discretion, including removing the challenged material from the website
or/and the cessation of the Member account.
If you firmly think that a
Member or Legal experts is utilizing your federally registered trademark in a
manner bordering on infringement or trademark, please provide NewLawyer with
this following:
(a) An electronic or
physical signature of a certain person empowered to represent the owner of the
registered trademark;
(b) Enough information to
allow the company to get in touch with the owner of the registered trademark or
its relevant agent, including a name, telephone number, address, and even an
email address;
(c) Identification of the
infringed trademark(s), including a copy of every relevant certificate of
federal trademark registration;
(d) Fairly sufficient
information that allows NewLawyer to pinpoint the use being disputed by the
owner of the registered trademark;
(e) Statement on the
registered trademark owners non-authorization of the challenged use and on his
belief that the challenged use is not lawfully authorized; and
(f) A statement that the
notification information is accurate and that the complainant is the owner of
the registered trademark or is entitled to represent him.
On receiving notice of the
challenges use, NewLawyer will verify the trademarks federal registration
existence and will employ the deemed appropriate action, at its discretion,
including deletion of the challenged trademark from the website, giving notice
to the Member or Legal experts in question, if, under NewLawyers discretion, it
is concludedthat the name or the mark in use is similar to the mark registered
and is utilized in relation with products or/and services coming under the
owners federal registration. This is unless the Member or Legal experts
presents his own registration or approved application covering the challenged
use.
Despite this, NewLawyer
will appropriately comply with the conditions of any court order pertaining to
the challenged party's behavior determined therein.
13. Other Website Links.
The website may provide
website links others site apart from its own for reference purposes only.
NewLawyer, however, neither endorses nor controls these websites and its
contents and its operators association.
14. Notice.
Notices or other
correspondence provided hereunder will be given in writing and forwarded (a) by
NewLawyer via facsimile, United States email or mail (to the address or number
that is provided), and (b) by you through email. The receipt date shall be
assumed as the transmission date of such notice in the cases of email or
facsimile and 5 days after receipt by the Postal Service of the US.
15. Regarding Assignment.
You cannot give the Member
Agreement or delegate any such rights or any obligations stipulated, in part or
whole, by operation of law or voluntarily, without the company's prior written
consent. Any such supposed delegation by you, without NewLawyer's prior written
consent of NewLawyer, will be null and void, unless NewLawyer expressed content
under its absolute discretion. However, NewLawyer may assign this Agreement or
any rights hereunder without your consent.
16. The Parties
Relationship.
Despite the provisions
stipulated in this Member Agreement, each party is independent and acts alone,
not as a contractor, partner, joint venture, agent, employee or employer of the
other and shall not bind or attempt to bind the other to any contract.
17. Arbitration.
Any claim or controversy
resulting from or pertaining to this Member Agreement, the breach thereof, or
its subject matter shall be settled by binding arbitration in conformity with
the consumer commercial arbitration rules of the American Arbitration
Association. The decision of the arbitrator shall be final and unappealable.
The arbitration shall be
conducted in San Francisco,
California, and the arbitration
award judgment may be entered in any court having jurisdiction thereof.
Notwithstanding anything to the contrary, NewLawyer, the Member or any other
party to the arbitration may at any time seek injunctions or other forms of
equitable relief from any court of competent jurisdiction.
18. You agree to utilize
(a) electronic means for the completion of this Member Agreement, to use the
Website and the Legal experts Services and for provision of any notices pertaining
the stipulated agreement, and (b) electronic records to keep relative
information to this Member Agreement or your Site usage.
You can ask a hard copy of
this Member Agreement and any other records pertaining to this or your Site
usage by sending a written request to NewLawyer. You understand and consent
that this Member Agreement and any notices given pursuant to this are
electronically enforceable.
19. Miscellaneous.
Should any Member
Agreement provisions be found invalid or unenforceable, such provision shall be
superseded by a valid, enforceable provision that most closely matches the
original provisions intention. NewLawyer's failure to act with respect to a
breach by you or others does not waive NewLawyer's right to act pertaining to
subsequent breaches. NewLawyer's failure to exercise any right under these
terms and conditions shall not constitute a waiver of such right or provision.
This Member Agreement shall be governed by and interpreted in conformity the
laws of the California
state. The parties acknowledge that this Agreement is a transaction involving
interstate commerce. The Federal Arbitration Act shall govern the
interpretation, enforcement and proceedings pursuant to the arbitration clause
in this contract. You consent that this contract and the Member policies
contained herein, and NewLawyer's enforcement thereof, are not intended to
confer and do not confer any rights upon any person other than you and
NewLawyer. This Member Agreement together with the policies of NewLawyer
constitutes the entire agreement between NewLawyer and you pertaining to the
subject matter hereof.
NewLawyer
Payment Policy
This Payment Policy is part of the Member Agreement. Other terms
not included herein are in the Member Agreement and other related policies.
1. Payment for Legal experts Services. A member
completing a transaction with an Legal experts through this Site is responsible
of paying all fees for the service. NewLawyer is not obliged to pay the Legal
experts any fees which are not yet fully paid by the member. Legal expert's may
authorize NewLawyer to collect from members, in their behalf, likewise, credit
said payment to the Legal expert's accounts net of all fees chargeable to said
transaction.
Live Calls and Recorded Listings. Legal experts may charge members a price per minute fee
for all live call or recorded listing transactions less connection charges and
a listing fee.
Paid Mail. Legal
experts may charge a fee for responding to Paid Mail requests less the required
commission depending on which category the transaction falls.
Groups. The Group
Manager of each group may collect a certain percentage from the Legal expert's
Net Fees from the Group listings. The percentage is determined by the
arrangement with the Group Manager, ranging from 0%-100% of the Net Fees
generated. The Group Manager authorizes NewLawyer to collect payments for all
transactions of the Group.
Satisfaction Guaranteed. At NewLawyer we always hope you have a
satisfactory experience. If there is a reason this doesn't happen we will
credit your account up to $25. This guarantee will not apply to an legal
experts used more than once. Also we only credit up to one
unsatisfactory consultation per month, and have the right to withhold
reimbursement at our discretion.
Special Programs.
NewLawyer has the option to let Legal experts participate in special offerings.
Although Legal experts are not obliged to join the program, accepting such
invitation, means they are bound by the conditions and policies in the
invitation and Member Agreement. All lawyers can offer a free consultation.
Lawyers can charge a per minuture rate for their clients. All
payments made by buyers are non-refundable. You are not obligated to
give freee consultations and can start charging your clients at your convinence. The
Promotions and Specials, such as FREE consultations and discounts are not
supported by the Satisfaction Guarantee.
Auctions and Bidding. Legal experts will be offered the chance
to bid for featured placement on the homepage and within the categories the
legal experts have placed themselves in. During the auction the top bid will be
placed in the section of the page being bid on. Please note that the legal
experts whose bid is accepted as the top bid will be responsible for paying the
amount they bid per click on the profile. Meaning if a user clicks on your
profile, you will be charged the amount you bid. Legal experts can stop the
charge by canceling the bid.
2. Legal experts Fee Remittance.
a. Legal experts Fees are paid upon request in US $ denominations
through the Member's account.
b. Legal experts are responsible for all hardware, software and related costs,
and paying the applicable state and federal taxes required by law.
c. NewLawyer, in its discretion, reserves the right to institute
charge backs as may be deemed appropriate, and withhold payment for fees when
it suspects that the Member may not be able to fulfill obligatory payments.
d. NewLawyer may close a Member account any time without notice,
in violation to all encompassing policies.
e. NewLawyer reserves the right to investigate a Member's
account identified for review. If results are not in favor of the Member,
NewLawyer may return funds, continue restriction for 180 days, or close the
account. Restrictions are because of the following reasons:
Ø Reports of issuing bank for unauthorized use of credit card or
bank account;
Ø Potentially receiving fraudulent funds;
Ø Excessive charge backs or disputes;
Ø Refusal to participate in any investigation;
Ø Posts unsolicited emails or links to restricted websites;
Ø Use of several Member accounts in different names;
Ø Return of funds due to insufficiency or incorrect bank account
number;
Ø Violation of the Member Agreement;
Ø Use of an unidentified proxy; or
Ø Any other situation causing NewLawyer to believe that the
Member's Account is primarily utilized for fraudulent purposes.
NewLawyer.com Legal experts Policy
The Legal experts Rules Policy is complied with the rules and
regulations as part of the Member Agreement, which would constitute the
relevant terms and conditions that should be proper for the usage of the
NewLawyer website.
The following should be adhered and conceived properly,
otherwise will result into termination of membership without the consent of the
suspected Member or Legal experts.
· You agree to the terms of not providing any Legal experts
Services which would need professional authorization.
· You agree to perform all for-fee statements that you contain
with other Members and may not try to circumvent throughout the Site using
third-party elements.
· You agree to not provide information on diagnosing illnesses
and other means of solving the case or act as a medical legal experts through
the Site.
· You agree to avoid offering any advice of any investing,
buying or any other transaction that concerns securities as well provide any
relation to endorsing any product or services nor any subject about lottery
figures.
· You agree to adhere to the law 18 U.S.C 2257 and other
regulations that limit you to provide information that are to be determined for
confirmation.
· You agree to give Legal experts Services only to Members and
seek assistance for suspected non-Member or more than one person that is
acquiring Legal experts Services.
· In any situation, NewLawyer allows only one Legal experts on
the phone with only one Member at a time and may restrict any type of
'double-legal experts' or 'tag-team calls'.

listing. However, NewLawyer may permit exceptions to this rule.
· You agree to bear with the NewLawyer policies that include the
Age Verification Agreement as well as the Adult Content Policy.
· You agree to only choose the appropriate listing of your
choice and on one category only.
· You agree to not use any type of banner advertisements that
pertains to any business-related transaction.
· You agree to not make or separate listings for a reason to
redirect Members from the listings that are contained in Groups.
· You agree to not make inconsequential listings and any other
listing that are inappropriate to the category listings that are created.
· You agree to not record any Member call and should provide
pre-recorded voice Legal experts Services only to Members in the agreed Legal
experts Rules Policy.
· You agree to honor any trademarked names, services, logos and
any other licensed subject as well as not reproducing or duplicate trademarks
for commercial purpose without the express written consent of NewLawyer. If you

· You agree to the knowledge that NewLawyer do not endorse or
recommend any information in regards to any Member or Legal experts as well as
any other referral or guarantee of any Legal experts by NewLawyer.
Additionally, you are not permitted to provide any information that suggests an
endorsement to any sites that offer information regarding about any matter.

information posted by users or lawyers.

Privacy Policy
This Privacy Policy is part of the Member Agreement and covers
information provided to the NewLawyer website. All other terms not defined
herein are included in the Member Agreement and related policies.
1. Children.
Minors are restricted from registering, taking advice or
submitting information on this website.
2. Security and Information Disclosure.
NewLawyer uses Secure Socket Layer (SSL) to help protect against
misuse, loss or alteration of information. Other measures undertaken to protect
user information are:
v Limited/regulated access by employees to all Member
information in the server;
v Employee's regular reminder of NewLawyer's security protocol;
and
v Provision of web security procedures with quality assurance
weekly.
NewLawyer does not disclose any identifiable information to
third parties unless Member has opted to. Consent to disclose personal
information will no longer be subject to our rigid Privacy Policy. NewLawyer
may only divulge personal information to:
v Appropriate authorities or banks to report any suspected
illegal activities to avert damage to other persons;
v Potential parties to a lawsuit regarding disputes with other
Members to mitigate liability;
v Service providers to communicate with payments; and
v Other NewLawyer entities worldwide.
3. Information Collected.
Information collected during the registration process includes member name,
real name, password, valid phone number, email address, and other personal
information in the registration form. The Member name you provide will be used
to identify with other NewLawyer members and will be visible to others who
visit this Site. Registration through co-branded pages will require disclosure
of information to its partnering entity subject to the entity's privacy policy.
Mail or email address and phone number will be used to contact
the Member of its account activities or new product offerings but Member may
discontinue this notice through the Customer Support form. Administrative mails
though will constantly be mailed and Member cannot opt to stop this service.
A Member with an Legal experts listing will be collected
additional information like Social Security number or Federal Tax ID Number and
credit card information as evidence of identity and for processing of Legal
experts fees.
Other data like demographic information, third party contact
information, internet cookies or IP addresses are asked to be used in
promotional activities, settle disputes, track sites that Members visit, or
diagnose server problems.
All changes in personal information will be made on the My
Account page or the Customer Support form or by writing to the mail address
provided below.
All Members are enforced to strictly comply with its Anti-Spam
Policy.
4. Account Cancellation and
Notification.
Members who wish to cancel their account needs only to do any of
the following: send an email with their Member name and email address, fill out
an updated support form, or send a letter to the mailing address provided
below.
Material modification in the privacy policies will be
communicated through email or will be posted in this Site 30 days prior to
implementation. This is to provide ample time to accept or not accept the
changes or simply cancel membership.

NewLawyer Feedback Policy
This Feedback Policy is part of the Member Agreement and is
included by reference therein. Other capitalized terms will be defined in the
Member Agreement and related policies.
All Members are asked to use caution, tact and good judgment
when leaving feedbacks to their Legal experts. Other members may be able to
read what you have written and you, the Member, can no longer edit those
unscrupulous remarks. It becomes permanent and is now part of the Legal
expert's record. But take note that you are to be held legally responsible for
libelous remarks and feedbacks. Damaging one's reputation for defamatory
remarks is a ground for slander. Under the Communications Decency Act,
NewLawyer is not to be held responsible legally for any feedback posted in this
Site, even if the feedback given is negatively constructed and offending.
NewLawyer has a feedback forum and rating system, which is a venue for the
Member to express their opinions. NewLawyer does not investigate the accuracy
of the opinions or the feedbacks nor does it censor these remarks.
However, to ensure precision and to avoid abuse of the feedback
system, NewLawyer has the right to remove feedbacks in the situations cited
below. If an Legal experts thinks that another Member has left a feedback that
meets any of the following (or more) criteria, you may contact NewLawyer.
Circumstances When NewLawyer Will Consider Removing Feedbacks or
Ratings from the Feedback Forum:
v When the feedback is written with no intention of describing
the Legal experts or the Legal expert's services instead is aimed to describe
or provide comments on NewLawyer.
v When the feedback contains blasphemous or offensive language,
or has adult material or adult content. Although the use of provocative words
like "fake," "scam," "liar," "boring"
or "sucks" is heavily discouraged, it will not be removed from the
forum.
v When the feedback includes personal recognizable information
about any Member like disclosing the real name, phone number, address, or its
email address.
v When the feedback contains hurtful comments about an Legal
experts who failed to perform the necessary actions or provide services that
are outside the scope described in the Legal expert's services' listing.
v When the feedback is made by an Legal experts for him or
herself directly or indirectly, using a third party or a secondary Member to
make said feedback or rating.
v When the feedback is left by a fictitious Member who, in the
registration process, provided false or wrong information, like its name or
numbers and cannot be contacted.
v When a Member leaves several ratings, comments or feedback
entries in order to harass or stalk one or more Members. NewLawyer has the
discretion, when it finds the feedback to be harassing and annoying, to remove
all other additional feedbacks except the original.
v When the feedback refers to a feedback to another Member,
provides links to other websites, or includes other Legal experts.
v When the feedback refers to disconnected calls, NewLawyer has
the right to remove the feedback if the cost of the call will be refunded by
the Legal experts.
v When the feedback is erroneously intended or left for another
Legal experts, NewLawyer may only remove it upon information by the Member who
committed the error.
Age Verification Agreement
Welcome to the Site's Age Verification Agreement. This agreement
is a legally binding agreement between you and our company, PhonetoPhone Inc.,
which is doing business as and hereinafter alluded to as NewLawyer. You should

This Policy for the Legal experts Forum is a part of our
NewLawyer Membership Agreement and is therein included by reference. Terms that
are capitalized but do not have definitions herein will have their meanings
placed in the NewLawyer Membership Agreement and other related policies. You
should be aware that in using any of the Legal experts Forums, which includes
but is not limited to any post of any content, replying to any post or starting
any manner of communication with other Legal experts, you are hereby agreeing
to the terms and conditions found on the NewLawyer Membership Agreement and are
bound by it and all additional rules and policies that are incorporated

There are certain restrictions imposed in uploading Legal
expert's photos and interesting materials:
v The posting of nude photos and pornographic or sexually
oriented materials are strictly restricted to the 'Adult Only' section
of the NewLawyer website. In no such incidence that images of children whether
partially or fully nude shall appear in any of its site area, including the
Legal experts Listing. In the event that it discovers child pornography or
images of children in any listing, mail or otherwise, NewLawyer reserves the
right to promptly notify the National
Center for Missing and
Exploited Children and/or the appropriate law enforcement agencies. Legal
experts are advised to adhere to the contents in the Adult Content
Policy of NewLawyer.
v Legal experts are strictly prohibited to transmit photos or
any materials which are considered unlawful, harmful, threatening, harassing,
tortuous, defamatory, infringing and invasive to the privacy of another.
Transmission or uploading of photos or materials which are also considered
vulgar, obscene, hateful, racially or ethnically offensive are severely
discouraged.
v Legal experts are also banned from posting or loading any
unauthorized advertisement or promotions of any photos or materials on
NewLawyer's website unless permission will be granted from proper authorities.
v Legal experts are advised to mail or post photos and materials
which are original and unique. Posted or mailed photos and materials are first
and foremost the responsibility of the sender or the Legal experts. NewLawyer
has no part and has no responsibility in the photos or materials which are
patented, have trademarks, or those that are considered trade secrets,
copyrights or any other proprietary rights of any party, or material protected
by intellectual property laws, right of privacy or publicity or any other
applicable legal law, unless authorized by proper authorities. It does not
exercise control over the photos and materials on the Legal experts' home
pages. It will not participate in any legal proceedings and shall have no
financial responsibilities that may arise from such actions.
Further, NewLawyer does not guarantee the accuracy, integrity of
such photos or materials. Furthermore, NewLawyer reserves the right to remove
or delete such photos or materials which it considered in violation to its 'Photo
Policy' without any further notice to the sender or Legal experts.
In all times, Legal experts' are counseled to abide by the terms
and agreement under NewLawyer Membership Agreement. By becoming a member
of NewLawyer, Members or Legal experts agree to the use of their photos or
materials for the purposes described in the membership policy and accept the
responsibilities and agree to the terms and conditions written in the contract.
On the part of NewLawyer, it guarantees its Legal experts to
safeguard their privacy and to comply with the terms and conditions set forth
in NewLawyer Privacy Policy.
